TAWAU: Two men pleaded not guilty in the Sessions Court here yesterday to nine charges of abducting, raping, hurting and robbing a teenager here.

Judge Egusra Ali fixed hearing for Ghazali Talip, 39, and Raymond Abd Gafar, 33, to Oct 6-10 pending the medical report of the victim.

The two are charged with abducting 19-year-old Erin Simon at Soon Yee Car Care Centre at Mile 3, Apas Road here between 7.30pm and 10pm on April 26.

If convicted under Section 367 of the Penal Code and read together with Section 34 of the Penal Code, they can be jailed for up to 10 years and fined.

The second charge under Section 395 of the Penal Code stated that both Ghazali and Raymond had stolen a gold ring worth RM80 from the victim by pointing a knife on her in a van at Mile 3, Apas Road between 7.30pm and 10pm on the same day.

If convicted, they can be jailed up to 20 years and whipped under Section 397 of the Penal Code, which provides whipping on conviction.

Ghazali is also charged under Section 392 of the Penal Code with robbing a Nokia 6600 cellphone worth RM400 from the victim in the van at the oil palm plantation in Kongsi 8 Road here between 7.30pm and 10pm on the same day.

The Section carries a jail term up to 14 years and a fine or whipping.

Ghazali is also facing another charge under Section 376 of the Penal Code with raping the girl in the van. If convicted, he faces a jail term of not less than five years and not more than 20 years as well as whipping.

The two accused are also facing a minimum of five years??? jail and not more than 20 years plus whipping if found guilty under Section 377C of the Penal Code, for putting their penises inside the victim???s mouth.

For another charge of putting their fingers into the victim???s private parts without her permission, both of them can be jailed up to 20 years and whipped under Section 377CA of the Penal Code.

Raymond is charged under Section 376(2) of the Penal Code with raping and causing injury to the victim with a knife at the same time and place. If convicted, he can be jailed at least five years and not more than 30 years plus whipping.
