Assault: Student sues cops, govt for over RM250,000

KUALA LUMPUR: A student is suing the police and the government for more than RM250,000 in damages, claiming that he was assaulted while in police custody for refusing to admit stealing 18 motorcycles in May.

The 17-year-old student who is suing through his mother, Normah Kasim, 54, a nasi lemak seller, filed the suit at the High Court registry here through his lawyer, Baljit Singh Sidhu.

He named the Pandan Indah police chief, Selangor police chief and the Malaysian government as defendants.

Besides seeking a declaration that his detention at the Pandan Indah police station was invalid under the law he also wants damages for pain and physical suffering from allegedly being kicked by police.

In his statement of claim he said that he had to be warded at the Ampang Hospital for six days because of serious injuries caused

by the assault on several parts of his body, especially the part which had just healed from a liver operation.

He claimed that he was not told the reason for his detention and was not allowed to meet his family or get the services of a lawyer while in custody.

He also claimed that his request to go to the toilet was turned down and he was only allowed to go to the toilet to clean himself up after shitting in his pants while being beaten.

He said that until now he was still traumatised, depressed, had no appetite and could not sleep at night.

He also could not socialise with his friends and had to be referred to a psychiatrist.

Notice of the suit has yet to be served on the defendants.
