Prosecution fails to give date of death
SHAH ALAM: The High Court here was told yesterday that the prosecution had failed to provide evidence on the actual date of the murder and death of Mongolian woman Altantuya Shaariibuu in 2006.
Counsel J Kuldeep Kumar, who represented Chief Inspector Azilah Hadri, said the Kuala Lumpur Hospital (HKL) forensic consultant Dr Nurliza Abdullah could only confirm that the bone fragments found at the scene were still new.
He said the prosecution should prove that the incident happened on Oct 19, 2006 through the time of Altantuya’s death, but Dr Nurliza was not able to confirm it, except giving a time frame of a year.
Kuldeep also submitted that the auxiliary policeman, Mustaffa Umat, who was on duty on that day, did not hear any explosion nor was aware of any unusual happenings taking place at the scene.
Kuldeep, who continued his submission at the end of the prosecution’s case, also questioned the failure of investigating officer ASP Tonny Lunggan to ask the land owner whether the site of the murder was in the same area.
He said the investigations by Tonny were incomplete from various aspects, including on the movement of the glock EAH 387 pistol owned by Azilah on the night of the incident.
Hearing before Datuk Mohd Zaki Md Yasin involved Azilah, 32, and Corporal Sirul Azhar Umar, 36, who are alleged to have murdered Altantuya, 28, between 10pm on Oct 19, 2006 and 1am the following day in Bukit Raja near here.
Political analyst Abdul Razak Abdullah Baginda, 48, is charged with abetting them.
Kuldeep also questioned the reason for the prosecution not calling two important witnesses, DSP Musa Safri and the Brickfields Crime Investigation chief DSP Idris Abdul Karim, who were involved in investigating the case.
He also mentioned the conversation between Azilah and his girlfriend, Lance Corporal Rohaniza Roslan, which showed that Azilah was worried about Altantuya’s disappearance despite the murder having taken place a few days earlier. Hearing continues on Aug 26. — Bernama
